1. Acceptance of Terms
By accessing or using StickandSell ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms apply to all users, including sellers and visitors who view car listings.
2. Description of Service
StickandSell provides a free platform that allows individuals to create car listings and print QR code stickers to display inside their vehicles. When scanned, these stickers direct potential buyers to the listing page. StickandSell acts as a marketplace facilitator only and is not a party to any transaction between buyers and sellers.
3. Account Registration
To create listings or order stickers, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
4. Listing Rules
You agree that all listings you create will be accurate, honest, and not misleading. You must own or have the legal right to sell any vehicle you list. You agree not to list stolen vehicles, vehicles with undisclosed major damage, or vehicles with fraudulent VINs. StickandSell reserves the right to remove any listing that violates these terms without notice.
5. QR Code Stickers
Stickers are printed by you at home using the printable file provided by StickandSell. Stickers are linked to a specific listing and cannot be transferred to a different listing. StickandSell is not responsible for printing quality or how the sticker is displayed.
6. No Fees
StickandSell is completely free. We do not charge any fees and do not process payments. You may create listings and print QR stickers at no cost.
7. Prohibited Activities
You agree not to: (a) post false or misleading listings; (b) use the Service for any unlawful purpose; (c) attempt to manipulate or scrape data from the platform; (d) use the Service to harass, threaten, or defraud other users; (e) interfere with the proper functioning of the Service; or (f) create multiple accounts to circumvent restrictions.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.
9. Intellectual Property
All content on the StickandSell platform, including logos, design, and software, is owned by StickandSell and protected by intellectual property laws. You retain ownership of the content you submit (photos, descriptions), but grant StickandSell a non-exclusive license to display that content on the platform for the purpose of operating the Service.
10. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind, either express or implied. StickandSell does not guarantee that listings are accurate, that vehicles are as described, or that any transaction between a buyer and seller will be completed. We are not responsible for any disputes arising from vehicle sales facilitated through our platform.
11. Limitation of Liability
To the fullest extent permitted by law, StickandSell shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of profits, data, or goodwill. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.
12. Termination
StickandSell reserves the right to suspend or terminate your account at any time, with or without notice, for conduct that violates these Terms or is harmful to other users, third parties, or the business interests of StickandSell. Upon termination, your right to use the Service will immediately cease.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes by posting a notice on the website or sending an email. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved through binding arbitration, except where prohibited by law.
